DISTANCE SALES AND MEDICAL TOURISM INTERMEDIARY AGREEMENT

Buyer (Patient / Customer):
Identity and contact details are as declared in the order form or during digital confirmation.
The parties shall hereinafter be referred to collectively as the “Parties.”
2. SUBJECT
The purpose of this agreement is to provide the Buyer with pre-information and to regulate the rights and obligations of the Parties regarding domestic and international health tourism services coordinated by Yourmedcare (examination, diagnosis, treatment, surgical operations, accommodation, transfers, interpretation, and consultancy).
3. SCOPE OF SERVICE
The treatment and operation plan is finalized only after the patient arrives in the country and is examined face-to-face by the physician.
Yourmedcare provides only coordination, consultancy, and organizational services. All medical procedures, diagnoses, treatment plans, and post-operative results are the responsibility of the hospital and physician performing the treatment.
Patients acknowledge and accept that medical procedures carry natural risks.
The scope of the package (treatment, number of accommodation days, transfers, interpretation, etc.) is specified in the offer email.
By proceeding with the treatment, patients declare that they have read and accepted the informed consent regarding surgical risks and post-operative care provided by the clinic.
Patients are strongly advised to obtain international medical travel insurance covering complications, emergency medical care, or post-operative follow-up.
3.1 Post-Operative Care
Patients are obliged to comply with the doctor’s instructions and to learn post-operative guidelines.
Any complications must be immediately reported first to the treating clinic, and then to Yourmedcare.
Yourmedcare may coordinate follow-up or emergency support but does not provide medical treatment.
4. PRICE, PAYMENT AND PRICE GUARANTEE
At the time of offer confirmation, the Buyer pays a deposit of 10–25% of the package price.
The deposit guarantees the price of the standard treatment package offered for a period of six (6) months. If the package content changes during this period, additional services, taxes, and expenses will be invoiced separately and collected from the patient.
The deposit secures the package price but does not cover additional charges or legal taxes requested by the clinic or third-party service providers.
The remaining balance must be paid prior to the operation, after the physical consultation with the doctor, either through Yourmedcare’s online payment system at the clinic/hospital or in cash.
Payment Methods:
1. Local Bank Transfers
Transfers within the same country are generally completed instantly or within 1–2 business days, depending on the amount.
They are faster and more predictable; therefore, patients may complete the transfer closer to the operation date.
Applicable for patients with bank accounts in Türkiye.
2. International Bank Transfers
Involve international banks, currency conversion, and intermediary banks.
Processing time depends on the sender’s bank, currency, and country, and may take 7–10 business days.
To ensure the balance is received before the operation, patients must initiate the transfer at least 12–14 days prior to the operation date.
Full bank details (IBAN, SWIFT/BIC, account name, and address) must be provided, and proof of transfer should be retained.
3. Important Notes
International transfers are subject to bank processing times and fees; late transfers may delay the operation. This situation may require the patient to revise their return ticket. This responsibility lies with the patient.
Yourmedcare is not responsible for international bank delays or additional fees.
For faster transactions, the online payment system or cash payments are recommended.
5. CANCELLATION, WITHDRAWAL, AND FORCE MAJEURE
For cancellations made more than 30 days before the scheduled procedure, the deposit will be refunded after deducting administrative costs (approximately 35% of the deposit is non-refundable).
For cancellations made less than 30 days prior, the deposit is non-refundable.
In case of cancellation for medical reasons, if a valid doctor’s report and an official letter stating “unfit for travel/surgery” are presented, the right of withdrawal exception in healthcare services applies in accordance with Law No. 6502, and 85% of the deposit is refunded.
In cases of force majeure (natural disasters, pandemics, flight cancellations, etc.), the Parties will negotiate to determine a new date.
Deposits are not refunded after surgery. Yourmedcare may provide coordination for post-operative issues, but cannot refund costs for medical complications or additional treatments.
6. DATA PROTECTION AND PRIVACY
The Buyer’s personal data is processed under KVKK (Turkish Personal Data Protection Law) and GDPR, and is shared only with contracted hospitals, physicians, translators, and the internal Yourmedcare team.
The patient declares that they have read, understood, and accepted the Privacy Notice and Explicit Consent Form regarding the processing of personal data. Without this consent, no treatment reservation, deposit payment, or service process can begin.
Consent includes the processing, sharing, and storage of personal data in compliance with KVKK and GDPR. Patients retain their rights to access, correct, delete, or withdraw consent.
Data collected includes: name, contact details, health information, payment information, and emergency contacts.
7. IMAGE AND COMMUNICATION CONSENT
Permission for the use of before-and-after photos and videos for marketing purposes will be obtained via written or digital consent and can be withdrawn at any time.

8. DISPUTE RESOLUTION
The Consumer Arbitration Committees and Courts in İzmir have jurisdiction.
The Parties agree to first attempt resolution through negotiation and mediation.
9. EFFECTIVENESS
The Buyer declares that they have read and accepted all terms of this agreement by providing payment confirmation. The agreement enters into force at the moment of digital confirmation and remains valid as long as the Intermediary Institution’s International Health Tourism Authorization Certificate is in effect.
