ARTICLE 1 – SUBJECT OF THE AGREEMENT
The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and/or marketing of treatment, surgery, care, and related health tourism services provided by Yourmedcare Medikal Turizm Danışmanlık Limited Company (“SELLER”) to the buyer. This Agreement has been prepared within the scope of the Law on the Protection of Consumers and the Regulation on Distance Contracts.
ARTICLE 2 – PARTIES

2.2 BUYER – PATIENT
Identity and contact information is provided by the Buyer. The SELLER is not responsible for incorrect or incomplete information.
ARTICLE 3 – SERVICE INFORMATION
The services to be provided, including treatment, surgery, accommodation, transfers, and consultancy, may vary according to the selected package, duration, and physician planning. Service fees and payment plans are determined via offer email or portal confirmation.
ARTICLE 4 – PAYMENT AND PRICE GUARANTEE
4.1 The Buyer makes a deposit payment between 10% and 30% via the online payment system provided by the SELLER.
4.2 This deposit guarantees that the quoted treatment package price is fixed for a period of six (6) months. No price increases will apply within this period.
ARTICLE 5 – CANCELLATION, WITHDRAWAL AND MEDICAL EXCUSE
5.1 The Buyer may cancel the reservation by providing written notice at least 30 days before the flight date. In this case, administrative expenses will be deducted from the deposit, and the remaining amount will be refunded.
5.2 For cancellations made less than 30 days before the flight, the deposit will be forfeited and is non-refundable.
5.3 However, if the cancellation within 30 days is based on a medical reason, it must be supported by a valid doctor’s report and an official letter stating “not fit to travel” or “not fit for surgery”. Otherwise, no refund shall be made.
ARTICLE 6 – DATA SECURITY AND PRIVACY
All personal data shared by the Buyer will be processed in accordance with the Law on the Protection of Personal Data (KVKK) and GDPR. The Buyer agrees that they have read and accepted the data protection and explicit consent documents.
ARTICLE 7 – COMPETENT COURT
In disputes arising from this Agreement, the Consumer Arbitration Committees and courts of the Republic of Türkiye located in İzmir shall have jurisdiction.
ARTICLE 8 – ENFORCEMENT
This Agreement enters into force when approved digitally by the Buyer.
